1. Acceptance of Terms
By accessing or using the Heka SoftLink Hospital Information Management System ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.
2. Description of Service
Heka SoftLink provides a comprehensive hospital information management system that includes:
- Patient registration and management
- Appointment scheduling and queue management
- Electronic medical records (EMR)
- Laboratory and pharmacy management
- Billing and revenue cycle management
- Reporting and analytics
- Integration with national health insurance systems
3. User Responsibilities
3.1 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
3.2 Authorized Use
You agree to use the Service only for lawful purposes and in accordance with your organization's policies. You must not use the Service to violate any applicable laws, regulations, or third-party rights.
3.3 Data Accuracy
You are responsible for ensuring the accuracy and completeness of all data entered into the system. Healthcare data must be entered and maintained according to professional standards and applicable regulations.
4. Healthcare Compliance
Users of the Service must comply with all applicable healthcare regulations, including but not limited to patient privacy laws, data protection requirements, and professional standards of care. The Service is designed to support compliance but does not guarantee regulatory compliance, which remains the responsibility of the healthcare facility.
5. Intellectual Property
The Service, including all software, content, and documentation, is the property of Heka Digital Technologies Ltd. and is protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible. We are not liable for any downtime or service interruptions.
7. Limitation of Liability
To the maximum extent permitted by law, Heka Digital Technologies Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
8. Termination
Either party may terminate this agreement with written notice. Upon termination, your access to the Service will be discontinued. We will provide reasonable assistance in exporting your data in accordance with applicable laws and regulations.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes arising from these Terms shall be resolved through arbitration in Accra, Ghana.
